A straightforward guide to IR35 insurance for UK contractors: how defence-only and comprehensive cover works, what each policy pays for, and why any contractor can be selected for an HMRC enquiry — whatever their status.

What is IR35 insurance?

Whilst you will make every effort to operate compliantly with the IR35 legislation — which for most contractors means operating outside IR35 — HMRC have never released, and are unlikely to ever release, their selection criteria for enquiries.

With that uncertainty, an opinion-based test for IR35 status, and the risk of an upper-level contract being used against you despite you having no right to see it (which is commonplace), any contractor remains at risk of investigation.

Dealing with HMRC yourself — particularly in an IR35 enquiry — is difficult, and it is far better to have someone experienced fighting your corner. Having IR35 insurance in place gives you the reassurance that, even if the worst happened, you would not be facing a potentially crippling bill alone.

Why IR35 insurance matters

Even a well-run, genuinely outside-IR35 contract can attract an enquiry. IR35 insurance is about protecting yourself from the cost and disruption of defending your status — and, with the right policy, the tax bill if a determination goes against you.

  • HMRC’s selection criteria are secret

    HMRC have never disclosed how they choose contractors for IR35 enquiries and are unlikely to ever do so, so no contractor can be certain they are off the radar.

  • Status is opinion-based

    IR35 turns on factors like personal service, mutuality of obligation and control — leaving genuine ambiguity even for contractors trying hard to stay compliant.

  • The liabilities can be severe

Types of IR35 insurance policies

There are two types of policy available to contractors that will cover tax and IR35 risks. Which one is right for you depends on how much of the risk you want to carry yourself.

1 Defence only

Tax enquiry insurance

A basic tax enquiry insurance policy covers an expert’s fees in handling your case in the event of an HMRC enquiry.

As soon as you receive a letter from the Revenue notifying you of a review or enquiry, you send it to the expert and they handle things from there — but the policy does not cover any tax found to be due.

2 Comprehensive

Full IR35 insurance

The more popular option is a full IR35 insurance policy, which covers both an expert defending your case and the liabilities if you are subsequently found to be caught by IR35.

Given that being inside IR35 is likely to result in a demand of tens of thousands of pounds, it is a risk many contractors are keen to avoid. Cover can be provided with differing limits of indemnity to suit your day rate and time contracting.

Shadow business secretary Andrew Griffith MP chaired an IR35 policy meeting in November 2025, asking experts what a future Conservative Government’s policy should be.
